I have been smoking weed for all the many years my x has known me & it was never an issued. He never even brought it up in our divorce or child custody hearing or in the 3 years since but now out of spite he’s taking me to court. I never smoke around my kids. I am the custodial parent & he has no visitation with the children.
It appears the father learned of the effect drug use has on custody (and that custody impacts child support he may be paying). So now he is exercising that knowledge. If your future judge/referee smokes pot, his allegations will yield nothing. However, if you appear before a prude, then you may have a huge problem.
Lawyer up! Do not appear unrepresented in any family court anywhere.

He may have changed his view of your illegal use of marijuana. Do you care for your children while under the influence of marijuana? Do you operate a motor vehicle occupied by your children while under the influence of marijuana? If so, some judges may view your conduct as neglectful.

This is a problem. It doesn’t matter that he is just doing it out of spite what matters is if they test you and come up positive the court can impose all kinds of things on you and change custody to him. Speak to a lawyer ASAP. You need to shut this down.
