I have an ongoing family court case that I can not afford to get to from the state my children and I are in to Wisconsin. I have advised the court of such and since the respondent (there father) keeps contesting to only wanting visitation and no custody and does not pay child support I am stuck in a bind. I was working an amazing job however once my divorce was settled he took everything including my career with him after posting crude things on the companies website. While I am going through the process of now finishing up the child support order does it look bad for me to seek help if needed? Can it be used against me?
If this is not a Georgia case you should be talking to attorneys where the case is pending. You need an attorney to assist you if you have a case anywhere. Because the response that you could not appear in court because you could not afford it will not keep the court from moving forward without you. If you had an attorney they could see if there are other acceptable ways you can appear in lieu of a physical appearance. But if you have not made a motion for those ways, you are ordered to be physically present at any hearing or trial. The court may make a ruling without you if you do not appear. And you cannot later contest or appeal that ruling since you had notice, opportunity to be heard and failed to appear in court.
