We are trying to adopt 5 children that have been in foster care for 1 year. My husband's sister lost them due to a meth addiction as the baby tested positive for meth at birth. She has voluntarily terminated her parental rights to let us adopt them. We have
had a pre adoption case study done and passed all areas. There are 4 different fathers who haven't been involved. The children are 12,10,8,4 and 1. The mother is still married to the 8 yo son's father legally. Even though the 4 and 1 yo children are not biologically his, he is legally their father due to marraige. He recently, about 2 months ago, started occasionally showing up for visitation at the foster home. He has had his license suspended due to non payment of child support and has also done jail time for this as well. He is currently on probation for a dui.The children to not know who he is and they do not recognize him as their father. He has hired a lawyer to get custody of the 8,4 and 1 yo. We feel it is an attempt to get out of child support payments.

Sure he has a chance. His rights have not yet been terminated, have they? If not, he can participate in the process. How far he can get, is unknown. Speak with the department that took them and is/should be working with your adoption. They can help and tell you how they are going to treat his efforts. They may need to press the termination harder.
