I was just arrested for my second DUI in Georgia. I did not blow in the breathalyzer and received a DUI less safe. Assuming the video is not in my favor and I am convicted, a lawyer that I talked to tr mentioned the possibility of a SCRAM bracelet or drug court as an alternative to jail time. I read the minimum for 2nd DUI is 72 hours. Does the 72 hours HAVE to be carried out in jail or would the alternative sentencing apply to all jail time?
If this is in Kennesaw Municipal you'll be lucky if you only get the 72 hours. Talk with your attorney but whatever jail time you get normally can't be accredited to something else (like SCRAM)

Hire the best local attorney you can afford to try for alternatives for jail.
I am licensed attorney who focuses on Serious DUI Cases such a 2nd DUIs, 3rd DUIs, 4th DUIs, and Felony DUIs and DMV hearings. I also have much experience handling car accident cases. Although the information I provide is helpful, it is not legal advice. Although Avvo makes it clear to consumers that attorney answers to questions are for general purposes only and do not establish an attorney-client relationship, some attorneys prefer to add their own disclaimers to answers. You can set your custom disclaimer here and it will be automatically added to your answers. Do NOT include any direct solicitations or contact information.
Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not.
