My ex-wife out of spite filed a criminal complaint against me for violating a protective order over a week after it allegedly occurred at my kids school during a father daughter dance. I understood before an arrest warrant or appearance ticket for a misdemeanor or felony crime can be issued that's historical and not based on the police officer's immediate response to a potential crime that a warrant needed to be issued from a Court of competent jurisdiction. Am I mistaken? The charge initially was erroneously criminal contempt 1 which was corrected to criminal contempt 2 which was dismissed. I basically was told to come pick up an appearance ticket by cell phone. Is that correct?
Under new laws going into effect on January 1 the police must issue an appearance ticket in most cases. Domestic violence may be an exception.
