My 12 yr old daughter went shopping for a dress with other girls, 16-17 and she purchased a dress for cash $100.00 she doesn't like the dress and the store states no refunds, does this apply to a purchase made by a 12 year old?
Many stores post a sign near the till to put customers on notice prior to checking out that there is a no return policy. Was there such a clearly visible sign, or was there some other form of notice in the store in a clearly visible location? If so, then I believe the item can't returned. However, you could argue that the transaction was a contract, and a mi or can't usually enter into a contract. This is a thin argument, but it may support return of the item. I am. not aware of any law that says a minor is not bound by such a store policy. Good luck.
Although this advice is offered in good faith and is intended to be accurate and helpful, it is no substitute for a full consultation with an attorney of your choice, and it does not establish an attorney-client relationship between us. However, I will be happy to speak with and meet you if I can help you here in New Jersey, where I have been licensed for 30 years. I accept criminal, military, ethics/professional responsibility cases, and basic estate planning matters. Good luck and best wishes with your legal issue. Regards, Lee A. Gronikowski
This is not a criminal law question. I would think she would be treated as any other customer but the thought of my colleague is interesting.
