Mortgage brokers and lenders have to be licensed in Florida. However, this does not mean that someone in California cannot hold a mortgage in Florida. Individuals who lend money to someone who buys their house do not have to be licensed. Banks that are headquartered in California but have branches in Florida can lend money on Florida mortgages. A mortgage broker licensed in Florida can broker a mortgage to a California lender. A mortgage lender licensed in Florida can sell a mortgage to a California lender. Regulation of banks, mortgage lenders and mortgage brokers is complicated.
