I entered a lease for a year to begin June 1st. Previous tenant lived in it for 8 years. In the lease, I asked that the house and carpet to be professional cleaned as well as the interior to be painted. This was written in lease.
I received an email last week from the maintenance manager of the property management who informed me there we are a lot repairs that needed be done to the house: carpet stained throughout and buckling, exterior need painting, garage dirty insects, dirty filters, etc. He informed me that they will get the interior painted, but the exterior when the weather is better. I inquired about the replacement of the carpet and the landlord refuses to replace. Got the key and still dirty but claim the cleaned. I have professional cleaning coming to clean. I have an asthmatic 2 year old. Can I be reimbursed? What's landlord duty to replace carpet before a new lease?
The landlord has a duty to fix habitability issues. Habitability issues are defects that endanger the wellbeing, health, and safety of the occupants. Typically you are talking plumbing, electrical, structural, and roofing issues. It is unlikely that a dirty carpet would be considered a habitability issue.
Your landlord has a duty to abide by the lease. If the lease calls for professional carpet cleaning, and your landlord had a professional carpet cleaner clean the carpets, he's done his duty, even if the carpets did not come out to your standard. If your landlord did his duty, then he does not have to reimburse you if you pay another professional to clean the carpet, and he has no duty to replace the carpet unless it is a habitability issue.
