I have my PERM approved from a consultancy and this PERM is valid for only 6 months. Right now I have finished my previous contract and waiting for the new job. And I'm on vacation outside US. After coming to US, can the employer file I-140 for me, even when I don't have the job currently.
The FORM I–140 must be filed within 180 days after the certification of the ETA-9089. You can be on vacation abroad or in the United States at the time of filing as long as the job position as certified remains available.
The I140 must be filed within 180 days, your physical presence doesn't matter. Contact the company's US immigration attorney for assistance.
Employer does not have flexibility to file I-140 when you return as there are strict timelines to adhere to before before the certification expires.
