My sons bio father has said he would sign rights over so my husband who has been dad for 4 years can adopt my son and change his last name. Do we need a lawyer?
You will have to go to court to do the adoption. Your son's biological father can sign the Petition for Adoption as a Co-Petitioner. His signature will have to be notarized, but that is all that he will have to do. You should expect to pay somewhere between $1,000 - $2,000 to complete the adoption. You will need a lawyer.
