It is October 8 and I have not paid my rent due to being put out on disability August 7, 2018 and have not received a benefit I’m only eight days later. Which 10 October it would make it where I pay a $50 late fee on my rent I’m not sure how he could be doing a three day pay or quit when it’s only the eighth of the month can you please help explain this to me
If you are late, the landlord is normally free to immediately serve a 3-day notice. There is no grace period (unless provided in your lease), and your financial difficulties provide no legal excuse.
Late fees are normally unenforceable in residential tenancies. Orozco v. Casimiro (2004) 121 Cal.App.4th Supp. 7. However, it is sometimes best not to press the issue, because the landlord would normally have the right to evict a month-to-month tenant by simply serving a 30/60 day notice - especially if the tenant has a history of paying rent late.
