I have cumulative injury from say 2008 to December 2015. But also a specific injury on November 2015. Will I get 104 weeks of TTD for cumulative trauma and another 104 weeks for Specific injury?
Each date of injury is entitled to 104 weeks of TD to be used within 5 years from the date of injury. However, TD does not run consecutively. Also, if there is overlap in the temporary disability period you will not get paid twice for that period. Given you have multiple dates of injury, you should really consult an attorney. Without one, the insurance company will no doubt try to take advantage of you. The fee is only 15% and consultations are FREE!
If the two TTD periods run concurrently, you will only get one for the overlap period.
