As a trucking company we where given a garnishment of wages for an independant contractor. We have witheld them before without incident our concern is this owner operator is paid via his own company name? He is the owner and only person involved in said company. He is questioning the legality of us withholding the garnishment since the checks are not cut in the name of the person listed on the garnishment directly? We just want to make sure we are not overstepping our legal rights.
The garnishment directs you to withhold funds payable to John Doe. Not what you owe to John's Trucking, Inc. But you should consult with a local attorney for advice on this - do not rely on a general information web site for legal advice.
Our Rating is calculated using information the lawyer has included on their profile in addition to the information we collect from state bar associations and other organizations that license legal professionals. Attorneys who claim their profiles and provide Avvo with more information tend to have a higher rating than those who do not. What determines Avvo Rating?Experience & background
