Our 3 week old son is currently in the hospital with kidney problems that should have been caught when he was born. The doctors told us they were concerened about his weight loss but not his fevers and projectile vomiting for every day for a week. They got CPS involved saying that we were neglecting our son and finally I had to threaten the pediatrition with a lawsuit in order tto get blood work done, which lead to us being here for over a week now. CPS is still harassing us and saying we are still neglecting our son just to cover for the pediatritions negligence. I would like to stop getting harassed and sue for malpractice and negligence. As well as emotional distress and loss of wages.
As a father of two myself, you have my utmost sympathy and empathy for your current situation. I expect that the hospital was Mercy Medical Center in Durango? It does sound like you have a potential medical malpractice action against the doctors and the hospital and that you should consult with a medical malpractice attorney in the area. There may be potential malpractice and negligence claims and it appears that you have suffered damages. You definitely want to sue the doctors individually, as well as the hospital. When I lived down there from 1992-2002, Mercy Medical Center was owned at least in part by the City of Durango and would claim sovereign immunity from medical malpractice lawsuits. I do not know if ownership has changed. An attorney in Durango will know that much more readily. I am sorry for your problems and wish you the very best.
I too am sorry to hear of this. As you may have figured out, the kidney issue may be the lesser of the concerns at this point as it seems like something else may be going on (hopefully not meningitis). You should contact an attorney in your area immediately as there may be a shorter time period for you to start the action if they are a public facility. In NY you must file a Claim with a the City within 90 days of the medical malpractice. It would be best to contact a medical malpractice lawyer in your area right away. Good luck.
You will need to contact an attorney who specializes in medical malpractice cases. These cases are complex. It is not enough to show that a doctor missed something that could have been diagnosed. You must have another doctor testify that the treatment fell below the standard of care in the medical community in order to bring a claim. You need an expert to handle a case like this.
