My husband is currently serving a 3 year mandatory sentence with a release date of 7/20/2022. He found out recently that he has a pending charge due to a simple misdemeanor in which the crime occurred on 8/13/2019, this resulted in a detainer being placed on him. We are located in Iowa and from what I've read, the prosecution has 1 year from the date the crime occurred to file charges or dismiss them. Would this still be the case with him being incarcerated?
Yes. The time periods apply to people incarcerated. However, a warrant for his arrest would suspend that time period.
The warrant tolls the limitations period and keeps it from running before he is brought to trial.
