Do police ever NOT file a charge after an arrest?

First check your paperwork to ensure you were not "charged" with a civil violation. If you were cited to appear on a given date and you showed up and were not on the arraignment list You should do nothing but wait for the police to either ignore you or issue a new citation and appearance date The responsibility for the next action is the states (police) I would not prod the bees nest further by inquiry> The step after you are re-cited would be to talk to a lawyer in person.

It is the DA who files the charges based on the police reports. S/he may decide not to proceed with this one but don't breathe a sigh of relief yet. The DA has up to one year to file misdemeanor charges.
