In Ohio Weapon Under Disability WUD is an F3 punishable for up to 36 months in prison. F4 and F5 there is a presumption of probation. And F1 and F2 there is a presumption of prison. The judge has to have good reasons to send an F2 to jail. However an F3 is open for the judge to decide. In gun tolerant counties probation is more the rule. However in gun non tolerant counties like Hamilton County, prison is more often the rule. The only good fact going is that it is a shot gun rather than a pistol. As for defense be sure your lawyer looks into suppression of the evidence if the search was not conducted constitutionally.
