My ex filed for child support he has custody of my kids and they sent us a guidline findings and it says I have to pay 580 in current support. I filed a response and requested guidline support an told them the Time I’m suppose to have with them 2nd and 4th weekend even years for Xmas and thanksgiving and spring break and I get them the whole summer cause they live out of state.. I don’t always get them for the time but wouldn’t my child support be calculated for the time that’s on the court order visitation? Do the judge usually go by what the child support office finds in guidline child support?
Any attorney is going to want you to define what you mean by don't always get them if you have a court order for a certain amount of time and you have not been exercising that amount by your own volition then they likely will set support based on your time share reality. If they have been kept from you that is another story out of state you best have an attorney represent your interests
Please be aware that any comments that I have made are preliminary and tentative and not based upon a thorough analysis of your case. I would need additional information and review the exact documentation to be sure of the above advice. The answer above does not create an attorney/client relationship and does not require me to answer any future questions.
