My husband and I got into a small argeument while we were not physical with one another he called the police to mediate this argumet. Due to the police coming out I was taken to jail for a Non touch battery. In Florida when the police are called out supposedly they must automatically take a person to jail? Is how the officer put it. He has since told the States attorney this is ridiculous he signed that he NEVER wanted to press charges and never filled out anything for the police. Now DCF is involved and wants me to take a urinalyis for them is it mandatory that I do so?
If DCF has probable cause to suspect drug use they can drug test you. You can refuse and they will need to get a judge to sign an order to force you. You don't mention if you have children and they were removed or DCF is involved for other reasons. If you have to go to court with DCF the state will appoint you a lawyer if you cannot afford one.
