I have a citation for theft in Wisconsin but the citation is not on the Circut Cort system. Should I still tell them my theft or take the chance it showing up in my background check?
I'd suggest honesty. If your future employer finds out about the theft, and believes you lied when you didn't disclose it, your chances of being fired are high.
If a question on the job application or in an interview asks about "arrests" or "offenses" lying on the application is just as likely if not more likely to cause a problem. The offense needs to be related to the position for the employer to consider it a disqualifier, but lying on an application can always be a disqualifier. If you would be handling money or movable property on this job, theft may be a disqualifier.

I would suggest telling a future employer about the citation ONLY if you are asked. If you are asked a question on an employment application or in an interview that asked "Have you ever been ARRESTED for a crime or ordinance violation?", then the answer is "Yes". If the question is "Have you ever been CONVICTED for a crime?", the answer is "No'. Don't lie in order to get a job. If the lie is discovered, you will be fired and having been fired may create trouble with getting a replacement job.

What does the employment application ask? Answer the questions truthfully. If it is not on CCAP that likely means that it was not a criminal charge.
