Greetings, I am a LPR on an IR-5 visa. I married my partner, a born U.S. citizen, 9 months after I became a U.S. resident. We have now been happily married for a bit over 3 years. Do I qualify to file for naturalization? Or must I wait the standard 5 years?
If you are living together with your partner and have had a green card for at least 2 years and 9 months, you are apply for naturalization. Please see https://www.avvo.com/legal-guides/ugc/applying-for-naturalization-part-one-
Mr. Shusterman's (former INS Trial Attorney, 1976-82) response to your question is general in nature, as not all the facts are known to him. You should retain an attorney experienced in immigration law to review all the facts in your case in order to receive advice specific to your case. Mr. Shusterman's statement above does not create an attorney/client relationship.
