I came to US on H4 visa, which is valid until 2018.
Recently I applied for TPS and EAD. TPS is still pending but I got my EAD a couple of months ago (I have still Not worked anywhere in the US, so my H4 should be valid). I had to visit my home country because of family reasons, so I applied for Advanced Parole document, received it and left US.
Now I am outside US, and plan to come back in a couple of weeks.
My question is:
- Do I need to show my H4 visa at the immigration or do I need to show my Advanced Parole document at the US immigration airport.
- Does the status of TPS matter in my case?
Don't try to solve this online. Speak wth an immigration attorney.
Mr. Shusterman's (former INS Trial Attorney, 1976-82) response to your question is general in nature, as not all the facts are known to him. You should retain an attorney experienced in immigration law to review all the facts in your case in order to receive advice specific to your case. Mr. Shusterman's statement above does not create an attorney/client relationship.
