My dad died in 2007, my mom never changed r.e. deed to her name. We are now trying to transfer r.e. deed to her Trust. Must I remove dad from deed first and record her as sole owner BEFORE recording the deed to her Trust? Or, can it all be done together with one filing?
If the date was in both their names you have to file an affidavit of death of joint tenant and a copy of the death certificate. That will leave the deed in her name and she will then be able to transfer the property into the trust with a trust transfer deed. If the title is some other form, that will change the process. No, you cannot do it in one transaction.
