My girlfriend and I are currently renting a room in a two bedroom apt sharing with another young lady. She is on the lease, and we entered into a verbal agreement to pay her rent bi-weekly. There was a problem regarding animals allowed in the apt by the lease, which was rectified as within a week of being brought up. She is telling us that she wants us out by March 5th, and that if we do not leave she will have the police brought in to remove us. Should I be worried? What are my options?
You have a month to month tenancy, and are entitled to 30 days notice - before a new month begins. The police can't remove you, unless she accuses you of being violent or dangerous, which is always possible. She can't lock you out legally. Technically, you don't need to move until April 1, but if you don't move voluntarily, and she tries for a legal eviction, it will take her months to get you out. More likely than not, however, she will try for an illegal eviction, which might give you a cause of action but nowhere to live.
