I am starting a precious metals business in Massachusetts. I need to know if a seller's permit is required to sell scrap gold and silver to refiners after purchasing from the public and businesses. What if I send it to a refiner in another state?
It probably depends on how you structure the business. If you are buying and selling whoslae, this is probably considered recycling and requires a special permit (see here: http://www.mass.gov/eea/agencies/massdep/recycle/approvals/). If you are just buying retail and selling wholesale, maybe not. No matter what, you will have to register to operate as a business in MAssachusetts, whether that's with the town as a DBA or with the state as an LLC, Inc, or other entity.
