Hi, I was arrested for DV an year ago in Alameda Country, California. However, DA didn't file charges in the Court. The case was never brought to the court. I went to the Superior Court of California after few months of arrest and requested for Criminal records, and the records returned nil. I paid for and got a certified copy of Criminal Records report.
Will the arrest record show up in the background verification?
Should i file motion to conceal the arrest records?
Should i disclose the arrest record to prospective employers?
So, I can't really speak to whether you should file a motion (that's not an area of practice for me), but as far as the background check, and the disclosure, while the arrest may show up on background checks for about seven years after the arrest, your prospective employers can't consider the arrest in making an employment decision.
