I have a trade account with Wayfair to do some drop shipping of products and I was contacted by a manufacturer that I need to remove the product and pictures associated with the product down by Monday.
Wayfair is a drop shipping company and I'm trying to see if taking a picture from the website violating any laws. I've tried browsing for answers and it's just not clear to me. Can someone please help me understand if I'm violating laws by posting the pictures even though I have permission with Wayfair? I don't have a contract with the manufacturer, but Wayfair does. I'm selling from Wayfair only.
It is possible that the manufacturer owns the copyright in the picture and allows Wayfair to use it but are not willing to extend permission down the line. It is also possible that the manufacturer sees a problem with your display of their trademark as you don't have a reseller agreement in place.
Find out what they are objecting to and then talk to ip counsel.
I suggest you contact a copyright attorney to review the letter you received, and other materials and counsel you what type of response is needed to close this matter.
