My ex girlfriend asked for a few bucks here & there to fix problems such as her kid's car etc etc and then later admitted to keeping the money. I am planning on filing theft by deception charges and if the amount of $20k is above the threshold for felony grand theft that as well. My question is, do I, as the plaintiff, need an attorney? To me its pretty cut & dry but I'd like advice from the experts.
Also, who do I contact about getting a subpeana for the facebook messages, texts & messages from an application called TextNow? I'm pretty sure I have the facebook messages, I just have not gone through my downloaded data yet but I am stuck on the others.
Finally, she lives in Middletown, Ohio & i'm in Fairfield, Ohio, whom do I contact about filing a report? Fairfield or Middletown PD or Butler County Sheriff since their both in Butler County?
If the crime occurred where you live, you contact law enforcement for the jurisdiction where you live. You cannot independently file felony charges. That decision is up to a prosecutor to take to a grand jury after review of the law enforcement investigation. You should contact an attorney for guidance about filing a civil suit and discovery of digital evidence.
