I was arrested over a year ago for possession of pot and paraphinalia. I was not charged or cited at that time l was 17 at the time and was released to my father. Last night I was pulled over and arrested for an outstanding warrant for those charges but the warrant was issued June of this year. I am 18 now and being charged as an adult. Is this normal and what are my options? The charges were in Mesa but the case appears to be in Maricopa county superior court.
Yes, the Maricopa County Attorney's Office typically (and unethically, in my opinion) often "sandbags" 17-year-old juveniles by waiting until they are 18 to file felony charges against them (Possession of Marijuana is still a felony in Arizona).
You need an expereieced, Arizona-licensed attorney to represent you. If you can't afford an attorney, a public defender will be appointed by the Court to assist you.
Yes, you most definitely need an attorney. You are now charged with a Felony in Maricopa County Superior Court. I highly recommend you contact an experienced Arizona Attorney, such as myself, as soon as possible. Most of us offer free consultations, so we can explain exactly what is happening to you either by phone, or in person.
Maricopa County normally won't charge a drug case until the lab results are received. That can take months. Whether they held the case until you turned 18 or waited until the results were back, the bottom line is either is legal. And, as a result you are now facing felony charges. In most first offense cases, you will likely receive a diversion offer. Retaining private counsel can expedite the process. And, in rare cases, might allow for different arguments if the facts of the case warrant a dismissal because of the time issue.
