My wife is a drug addict and she uses drugs in front of and around my kids when she has them. I am having trouble coming up with the money to get a lawyer so I want to know if I have other options of filing so I can get it done before she takes off with the kids to Memphis, Tenn where she has family.
I would encourage you to come up with the funds to retain counsel. Custody matters are complicated and your case will require extensive preparation even before filing --- your case will likely be doubly so because you will want and need an emergency order of custody, which would immediately move the children into your care.
Short of taking such action, you could report the mother to DSS. If DSS is able to corroborate your accusations, they will likely remove the children from her care immediately, and seek to place them with another family member (such as yourself, if you don't have a criminal background or history of drug/alcohol problems). Be forewarned, though --- I find that DSS can be very unpredictable in their actions, and you very well may not end up with a desirable result if you pursue this option.
