I leased a business for a year and was just served a quit and vacate. Out lease was oral. My July rent is 12 days late because of no cooling unit repair after a year that was agreed on. What is my rights?
While defects in the premises could be construed as constructive eviction, that typically doesn't give you the right to withhold rent that is otherwise due, as you are still occupying the premises. The next step after the 3-day notice is to serve you with a complaint and summons, and expect your landlord to ask for reimbursement of attorney's fees and costs associated with having to bring the lawsuit.
