I sold a atv without a title and the guy picked it up and payed in cash and all wasorts good and I was going to try and get him the title now after a little while he is saying that he wants his money back and that I could go to jail for selling a atv without a title and he wants a full refund nothing about a return was Saidoing in the agreement do I have to give him his money back as far as I'm concerned he bought it and agreed to buy it and it was a done deal
The answer depends on the terms of the agreement. Did he buy it on the condition that you would deliver title? Or did he buy it knowing there was no title? Generally, delivering good title is part of any sale of a vehicle. Assuming the ATV is still in as good shape as it was when you sold it, you are probably best off just taking it back and giving him the refund. Then you can clear up your title problem and re-sell it.
I agree with the previous answer and you could sign an affidavit of lost title and release of interest and then he can apply for title in his name. Private sales are "AS IS" unless otherwise stated in the agreement.
