I was involved in a accident and was at fault. My insurance has paid everything. Now they want restitution, but he sighned a release form and received his money?
You should be protected if it is a valid general release but call local counsel for a quick answer.
The release covered civil damages but not necessarily restitution which occurs in the criminal context. So unless there is a criminal case you do not owe anything else because the release your insurer obtained should have covered everything. If there is a companion criminal case, show the civil release to your attorney who can make the prosecutor aware of it.
