I am being evicted due to my sublandlord having a personal issue with me. My sublandlord used to be my best friend of 12 years, however when I expressed that because of various reasons I did not want to have a friendship anymore, only sublandlord/subtenant kind of relationship, I then received an eviction letter 2 days later, even though I pay my rent every month on time and have even been told by this same sublandlord that I am “the perfect roommate.” the letter was dated June 11th, says I need to be out by July 14th, does not state why I’m being evicted nor anything about payment. And now I’m being harassed every day that I have to pay for July’s rent. I am leaving July 6th, which is a few days shy of the 30 days, do I indeed have to pay rent for July?
Dear Bronx Roommate:
Your friend is not a "sublandlord" in relation to you as you are a Roommate--not a subtenant. If the tenancy is month to month, the tenant may end the Roommate arrangement with an NYC Thirty Day Tenancy Termination Notice.
If the Rent Due Date is the first day of the month then the end date for the "tenancy" is July 31, 2018 (not July 14, 2018) if the tenant also properly served the termination notice (delivered to you by a process server?).
So there is no point in mentioning whether you should pay rent for July, if you made plans to move based on a defective (no legal force and effect) termination notice.
