I was given a dog by a friend. When he broke up with his girlfriend she abandoned two dogs at his house. After 2.5 months of telling her to come get her dog through text message he gave one to me. Now she is saying she contacted the police to get the dog back. She never came to see the dogs or even buy food for them. Does she have a case?
Ex GF will likely make the argument that ex BF was caring for her dogs with permission until she found a suitable place to live. Further, you were on notice the BF did not have clear title to the dog that was given to you. Unfortunately, it does not sound as if BF complied with the typical laws as to abandoned property that could have vested him with rights to dispose of the dogs. Likely GF's ownership rights would be found to be superior to yours by a Court but you have a counterclaim for all the monies you have spent on caring for the dog.
Any answer provided on the AVVO website is for informational purposes only and does not constitute legal advice for your specific situation. You should always seek legal advice before taking any action which may affect your future rights. Your local legal aid office may well provide information or access to free legal advice and your state bar organization may provide referrals to reputable attorneys who will provide advice on a reduced cost basis.
You have a weak claim legally.
However, it is unlikely the GF will actually do anything. Document all your expenses in caring for the dog. In the unlikely event an action to recover the dog is actually filed, you can assert a counter-claim for those costs.
