My wifes daughter who is 38 years old and has been staying here in the house that I own will not leave when I ask her to move out. She is very disruptive and disrespectful, she does not pay rent and is NOT welcome!! Her mother says that she can stay but I say NO!!! Only my name is on the title of the house until my death and I want [info withheld}. Anna claims that I can only evict her through the courts and refuses to leave. Do I have any rights at all?!!
Of course you have rights. Just one question to be asked is how long the daughter has resided in the home.
You state the daughter is 'telling you what law is'. With no question, for the situation you describe, I urge you to choose a seasoned, well experienced, knowledgeable attorney to provide you with legal counsel & guidance.
The situation you describe reminds me of a recent case in which the person who was akin to 'the daughter' (in your problem) turned out to have had nothing but string of prior evictions including a few in states adjoining MN.
If you reside in a somewhat rural area, know that a very few of us routinely make special arrangements to provide legal counsel to such people.
