My story is like this: i have entered into US on a tourist visa in August 2012, based on a 6 months admitance and overstayed I-94 1 year and 4 months ( i left US in June 2014 ). While in US i married a US citizen ( in April 2014 ) but because i got scared i left her and run. Before leaving i signed some divorce papers and a Affidavit that i will leave US and i will be unable to attend a viewing and i was asking the judge to divorce us without me being present. I mail these documents to her hoping that she file them.
Now i want to get back into US and dont know if i will have problems at immigration customs in the airport. I mention that i surrenderd the original I-94 to the airline i flew with when i left. Is there a chance the the immigration didnt run my file?
You overstayed on your visa so most probably your tourist visa has been canceled. Given to the duration of overstay you are also looking at a three year bar on entry.
