Hello my name is Julie Newman. Three years ago I was in a accident which I was deemed at fault. The accident involved a septa bus which had passengers on board. My insurance company geico settled claims up until the last passenger came forward the day before the claim closed in which case geico had already exhausted all my funds. The claim was taking to arbitration which they awarded her 5000$. I need to either appeal the case or pay the judgement. However I was looking to see if there is any other rights I’m entitled too in which case geico would have to pay the judgement?
There would need to be an investigation to determine if Geico acted in bad faith by settling some claims against you, but not all. If Geico acted in bad faith it will be obligated to pay the other claim & perhaps other damages. It is possible that Geico was unable to settle all the claims within your policy limits & it acted appropriately. Your practical problem is if your personal liability is $5000 it's likely not worthwhile to hire a lawyer to investigate. For the future, you need to make sure your liability coverage limits are sufficient to cover you for multiple claims like this.
