I call her mom..Mom had a shop/outbuilding that was full of trash/ debris from previous renters, After we decided have a go at cleaning it In the debris found several pieces of equipment/ mig welder, torch outfit, radial saw/skill saw etc. The equipment was broken or missing parts and essentially discarded. I spent considerable time/ effort and was paid to repair/restore the equipment at fraction of cost of replacing it. i used the equipment every day maintaining the property . The value of the equipment approx $2000.00. The daughter arrived in August 2016 announced she was taking Mom to live with her and was selling the house/everything on the property. She got a POA. I asked mom if she thought the contents of the shop should stay with the property til it sell because I use it every day she said yes.
Oct 15 2016 she Gave me control of all the equipment in the shop to use while i live there and take it with me when I leave. She did this in her own handwriting and signed and dated it. She wanted me to be able to use it to help myself and others, daugh threatned me with theft so I left it when I moved
Can I sue for replacement equip?
You may have an enforceable agreement. It depends on the language of the signed document and whether this person was of sound mind (able to enter into a contract.). You could also have a claim for what is called unjust enrichment if you conferred some benefit upon "Mom" and you were not adequately compensated for the work you did for her. Due to the amount at issue, you may want to consider filing a small claim lawsuit (limit of $5,000) which you can handle on your own. Forms are available online or at the courthouse.
