I need help defending what I believe is my son's right to free speech. This case is regarding a comment made about another kid on an istagram chat group. The comment was made on a weekend not during any school activity. The school is trying to suspend my son over this one comment. There are also other students involved but I have not reached out to there parents. Everyone I have shared the group chat with has agreed with me the school has no right to get involved in any discipline regarding the comments. Please let me know thoughts on this issue. We have already appealed the suspension and now find out what the district administrator has decided tomorrow morning at 8am. She has already stated she will have some type of disciplinary action. Please help! We are located in Richfield, WI.
I would need more information to answer definitively, but I do believe the school district would be able to discipline your son for an "out of school" statement if it has an impact "in school." The questions become: why did he make the statement? Is there an excuse or justification for the statement? Can they prove that he made the statement? Is the punishment disproportionate to the offense?
