Hope you can help me get some answers I am a stylist at an International salon/spa in Nevada. I was also managing this salon for years. Recently the owner decided to make some changes after I advised him that an employee was planning to leave and was going to the labor board to sue for wages. Law here requires employers to pay at least minimum wage. This is a commission paid salon. So she would have been entitled to back wages. He had a past employee go to the labor board and the owner was forced to pay this person 5000.00 in back wages. So once the owner knew this girl was planning to do the same thing, his resolution was to offer her my position as manager if she stayed, thus, keeping her from going to the labor board. Now keep in mind I was this girls manager for years. She at one point was givin time off by me for rule infractions in the salon. Now that she has my position that I held she is micro managing me hoping I will quit and move on. She is constantly harassing me about how much I charged for services or I didn't charge enough. I had told corporate( not in writing ) about the hostility that she is portraying. Its pretty obvious. I can see that she is intimidated by me as
You are in a tough position. You do not have standing to enforce the payment of minimum wage on behalf of another person, so unfortunately the basis for this woman's promotion is almost irrelevant. What is relevant is the harassment to which you are being subjected. In Nevada, an employer is allowed to fire anyone for any non-discriminatory/unlawful reason. So in order to pursue an action you would need to demonstrate that the harassment is unlawful, which is not clear in your post. I would encourage you to talk to an employment lawyer about this issue further.
