I had a trial and I don't feel confident with the Attorney I had. I plan to retain a new Attorney ASAP to help with some issues that have come up.
The post trial documents that are due before the verdict is given out by the judge are due in a couple of weeks. The lawyer I had is waiting on the transcript from the first trial day. They told me they need it to listen to in order to do the post trial paperwork.
If that transcript is not provided before the due date does that mean the paperwork is still due or can it be postponed? I ask because I don't have confidence I'm getting the right answer.
If the transcript turns out to be lost entirely, then my lawyer can't do the finding of facts and whatever else because they are missing an entire day of testimony. In that case would the judge have another trial day? My lawyer hasn't answered this clearly and my spouse told me that they've been advised that the paperwork has to be turned in and there's no need for the transcript. I don't see how that seems fair when the transcript is being reviewed to find the items stated in testimony that were false or true?
Way ahead of yourself
When was the transcript ordered and how long have you been waiting?
The judge will generally grant more time if there is delay for transcripts.
If you are going to have another lawyer post trial now is the time to secure the lawyer. The new lawyer will need some time and may obtain an extension
