They will normally swoop in and immediately take the baby away from the mom if it is a "dirty baby". Sometimes the father can get custody at this point. Mother will need to get clean before she can move for custody.

Was the baby tested? Did the baby have addiction issues at birth?
CPS will do a full investigation. You should consult with an experienced family law attorney so that your rights are not in jeopardy.
