Have a $900 hospital bill ( I incurred personally ) on my credit report from 6 years ago. On my credit report, the unpaid debt is listed as " joint responsibility "
Our final divorce decree lists my darling ex- husband as the person responsible for repaying that particular account. I have corresponded with the collection agency and provided them with proof of the court order. The agency still claims I am responsible and insists that I file a civil claim against my ex-spouse to remedy the collection. I have a pending dispute with the credit bureau, but if that doesn't work, any suggestions? Thank you for your time. I'm buying a new home and the better my credit the better the rate!
The creditors are not parties to your divorce case. If you owe money to the creditor, it does not matter to the creditor to whom the court assigns the debt in your divorce case.
If the debt is from 6 years or longer ago and the creditor has not sued you and you have not made any payment to the debt or re-promised to pay the debt within the last 6 years, the statute of limitations for the creditor to sue you may have passed.
