The arrears amount garnished is a very small amount and he makes a very good income. His income tax was intercepted last year and given to me. My question is, since he has the financial means to pay more towards arrears, will DCSS take away drivers license, passport, put a lein on his house, etc. or is that something I need to file for?
You would have to request DCSS to file a motion to modify the arrearage payment. Whether there will be a license hold depends whether is in compliance with the court order requiring the repayment of the arrears. If he is in full compliance there normally will not be a license hold. DCSS will still capture his tax refund to apply to the arrearages.
If you have evidence of a significant change in circumstances, you may always file for a modification of the arrearage.
