Although my husband has been sentenced and is serving time..will we have to get another fed lawyer to go over his case to see if he qualifies under 'the first step act' or can we still use the same fed lawyer he had in the beginning of his incarceration?
I suggest you contact the Federal Defender Office in your area. They can tell you that you if the Act will help you.

There is no appointment of counsel to review for changes in law. But Federal Defender Offices are the groups around the country who are knee-deep in getting the First Step Act applied. You can hire your own lawyer, including the lawyer that was earlier appointed, but the Court will not pay this fee. Bon courage, and I hope the Act helps.
