The driver ricky lee got pulled over for outstanding warrant and i was the passenger. He had a little baggie of meth. We both got charged with possession of meth but on his citation it says .4 g and mines said .8 but we we were charged with the same bag. my citation it says charged possession of meth and conspire to deliver to Ricky Yang . I don't know who Ricky Yang is and there was no Ricky yang with me and how can they have error? I I never got to see my motion of discovery and my attorney did everything on their own. I never sold or deliver thing. I'm just a user, can I they charge me with delivering when I never did?? This is also my first offense never been charges with anything and nothing on my criminal background. I'm only 17 at the time I was charged and I can't afford an good attorney? Ended up getting a cheap local attorney,I let my attorny handle my case and she never looked into my case. I ended up with probation and 3 months of rehab. When the other person with me got his case dismiss and he had a court appointed attorney. We had no idea the amount or weight of material but shouldn't the officer show us or weigh it in front of us if that's what being charged?
You didn't mention whether you pled guilty or whether you were found guilty at trial. If it was a trial, was it District or Superior Court? You may be able to get the case re-opened due to ineffective counsel, or appeal if you were found guilty, but that doesn't mean your case will be dismissed. You could be found guilty again, even with effective counsel, and the consequence could be worse than just probation.
