Lastly, me now being displaced of home and anxiety, her father has been released for child endangerment and there wasnt an protective order issued/filed @removalwith my daughters best interest in mind, I would like to file for one, tried and got denied. my re: with regards to me mainly stating that restraining order presumption under family code section 3044, that an award of sole or joint, physical custody, or legal custody of the child to the restrained party is detrimental to the best interests of the child. which he is scheduled to visit her twice weekly just as i.
