My son is 10 years old. He and a friend set fire to a bush at our apartment complex causing damage to the building as the fire went from the bush to the building. It was occupied at the time so we are looking at possible felony charges. According to my son his friend is the one who had the lighter and lit the fire, but they both lied about it when questioned. Is my son too young for jail time or could he be facing time in jail because of this act?
Your son is old enough to be under the jurisdiction of the juvenile court, so a sentence including detention, though unlikely to be served, is possible. He should have a lawyer if he is charged.
