I live in Dekalb County in georgia. Recently there was an where I was issued a citation by county animal control for a "general owner responsibility violation" or something of that nature. However, when the incident occurred, my dog and I were in a gated dog part owned by the apartment complex I live in, and the lease I signed specifically states that dogs are allowed to be off leash in the dog park. Furthermore, section 5-4 of county ordinance 15-09 states "It shall be the duty of any person to keep an animal under restraint and control at all times while the animal is off the real property limits of the owner. Such areas shall not include county parks that are specifically designated as off leash areas." However, the incident took place outside the dog park because my dog was able to jump over a stone wall section of the barrier. I have already been given a citation and am going to have to go to State court (was originally in recorders court, but was transferred to jury division). I looked up the case online, and it is registered as a misdemeanor, but does not list a charge. I want to know, given this info, a lawyers opinion on possible or likely outcomes for this case.
